My mother passed 8/27, she was a widow. It has been my understanding that anyone that worked and paid into SSI was entitled to the one time death benefit (At this time, it is $255.00)Is this not true? Please advise.

Phyllis, sorry for your loss. According to the SSA website, the one-time $255 benefit is for the surviving spouse or to the deceased's surviving child. You may want to contact SSA directly to find out if there are exceptions to this rule. (800) 772-1213

My brother has been living off of his wife's social security death benefit for his family. She was the bread winner. He has been recieving a maximum death benefit for 7yrs for he and his 3 children. His oldest turned 18. He claimed he lost 1/3 of his benefit. We told him to file for her benefit to finish school. Does his maximum family benefit really change. We also took his oldest to the S.S office and had her benefits deposited into a joint account with her father. She is not finished with High School until May 09. My brother claims that S.S. has taken the money out of his benefit and he will not be able to pay his mortage. Help my brothers procrastination is now an emergengy in Florida. Yes we have already told him to get a job....

If your nephew still has a legal guardian, the guardian should contact the local Social Security office. Your nephew is still entitled to the benefits regardless of his brushes with the law, but the Social Security office will be able to explain any changes that may occur as a result of the juvenile court.

My husband passed away in Dec. 2007. My daughter and our 4 grandchildren live with us. My husband was basically supporting everyone. Are my grandchildren eligible to collect?

-- Contributed by: patty

Sean, Yes, that is true. You and your sister are over the age of 19 so you are not eligible, but your mom's granddaughter would be eligible.

-- Contributed by: SusanWeber

Upset Mother,

Yes, it is true that there is a minimum number of credits required in order for a dependent to draw on their account. It may not seem fair, but it is part of the requirements.

My sister and I just lost my mother of 47. I am 25 and my sister is 28 with 2 children unmarried. We were told we are not elligible for any benefits but I heard from a friend that my niece (sister's daughter, mom's granddaughter) would be. Is this true?

My husband was involved in a car accident in 85, he lived in a coma until 92, we have two children together. I was remarried during that time, however; divorced before he passed away. I received benifits for myself and my two children until the youngest was 19 then all benifits stopped. What I want to know is am I still eligable for survivor benifits, I am still single and someone from the family told me that I should still be receiving them, is this true...

Jen,

The receipt of SSI benefits is based on the relationship of the individual to the deceased as well as their relationship and responsibilities towards children of the deceased.

I suggest that you call Social Security and explain your situation. They will be able to give you a specific answer.

Tallex Mom,

First, let me express our thoughts for your loss. Secondly, she would have had to work ten years before her children or parents could be eligible for any benefits. Thirdly, the executor of her estate should file her final tax return in order to pay taxes owed or receive any income tax refund.

Thanks for your questions.

my 20 year old daughter recently passed away. Is there something I should do with social security? what about tax refund she is due?

Maria,

Adoption can often lend a whole new dimension to Social Security benefits. Give the Social Security Office a call. Be sure to have all your adoption dates and date of death available for the call.

-- Contributed by: SusanWeber

Beth,

This is a somewhat complicated situation. You should really contact your local Social Security office for a detailed answer.

-- Contributed by: SusanWeber

one of our adopted sons is receiving death benefits from his birth father that recently died because he was receiving disability benefits from his fathers disability that ssa found was there prior to the adoption being final. There is another son that was adopted prior to the birth parent being found disabled and was not allowed benefits from the disability. Due to the birth fathers death and he was the birth father to both, wouldn't all of his minor children be intitled to the death benefits even if they were adopted prior to the disability? I am confused on this one. He was the birth father to both prior to his disability and their individual adoptions.

My father passed away this past April, we have been told that my mother can collect his social security if she choses. they were divorced and both remarried. Mothers husband has died (she is now collecting her own social security) and fathers wife does not collect on fathers because her own social security is larger. Can my mother collect on her ex husbands...they were married 23 years and it would be more money for her if she could.

Dana,

Depending on your particular situation, the benefits may or may not be retroactive. You should contact your local Social Security office or call the 800 number. They will be able to give you an answer.

I just found out that I can receive benefits for my children since their father passed away. Do they retro the payment from the date of death or the date of the application?

-- Contributed by: Dana

Karen,

You should discuss your specific situation with the Social Security office in your area or contact them on their 800 number. Be prepared to show any legal paperwork from the custody hearing may be causing the move of the child from the mother's home to the home of the grandparent's home.

If a child now age 16 has been receiving his biological fathers SS death since age 6, if the grandparents are given temporary custody through the courts of that said child and he is no longer in the mothers home and custody, the child has started highschool and has 3 yrs to go, is the mother still going to receive those benefits with the child not living with her? Can these benefits be sent to the courts for disbursement as needed if the child is living with them under court order? What can be done to assure the child gets the death benefit?

-- Contributed by: Karen Healy

Kathy,

According to the Social Security website, "The number of credits you need to have family members be eligible for survivors benefits depends on your age when you die. The younger you are, the fewer credits you need, but nobody needs more than 40 credits (10 years of work)." Under some exceptions, a child or spouse can receive benefits if they have six credits (one and a half years of work) in the three years just before the death of the husband or father. You should contact your local Social Security Office or call the 800 number for details.

my grandson is 9 years old. His father died last October 2007 and my daughter applied for death benefits for his son and was told that he had not worked enough credits in his life for his son to be able to receive benefits. Can you explain this to me, I was under the impression that had he worked at all Social Security pays benefits to the deceased children.
