Generic Medical Release Form

Whenever a child or student takes part in an activity sponsored by a school, community group or any other organization, it's very important for parents to sign a generic medical release form.

What is a Generic Medical Release Form?

Many people think that a medical release form is a way for schools or organizations to be released from liability for any injuries that students or children may incur during an activity, but this is not the case. A generic medical release form is a way for the people who are running a sports or outdoor activity, which has a potential for injury, to ensure that the necessary emergency and medical information about the child is on hand for emergency personnel. This is very important, especially since the new Health Insurance Portability and Accountability Act (HIPAA) of 1996 was adopted by the federal government. This Act requires permission not only for the release of medical records and information, but also for doctors and emergency staff to have permission to perform medical procedures on a young patient.

What Needs to be On a Medical Release Form?

There are many variations of the generic release form, but in order for the document to be legally binding, it must have several important sections. These sections include the following items:

  • Identification of the child
  • Identification of the legal guardian or parent
  • A statement of permission for medical treatment in the event of an emergency
  • Basic medical background about the student or child
  • Contact information for the child's doctor
  • Immediate family or alternative emergency contacts

Legal Guardian or Parent and Child Information

At a minimum, the opening section of the release form should identify the child's name, as well as the names of the parents of the child. The parents' names are often simply a signature at the bottom, but some forms dedicate an entire section to more detailed parental information. This section usually has fields for:

  • Parent or guardian's name
  • Address and phone number (both work and home)
  • Cellphone number if applicable
  • Insurance company and policy number
  • Who to contact if you can't be contacted (provide at least two other emergency contacts)

At a bare minimum, this information is critical because it allows medical personnel to get in contact with you immediately and perform potentially life saving medical procedures as soon as possible.

Statement of Permission

The statement of permission needs to state clearly that medical personnel have your permission to treat your child in the case of injury or sickness. Various forms detail specific medical procedures or actions, but the general purpose of this section is to give any doctor or technicians legal permission to treat an injury or sickness. The following excerpt is an example of how you could write such a statement of permission.

As the parent/legal guardian of ______________, I hereby give permission for the aforementioned student to receive appropriate medical attention necessary in the event of an accident, injury or sickness. I authorize all licensed physicians, dentists, technicians, nurses and other medical staff to perform any diagnostic, treatment or x-ray procedures to the aforementioned minor. I hereby assume responsibility for the costs of those medical treatments.

This paragraph satisfies the legal requirement for doctors and staff to have parental permission to perform any medical procedures on a minor. It also satisfies the requirement of any hospital that requires a parent or guardian to assume responsibility for payment before certain medical procedures may be performed.

Basic Medical Background and Doctor Information

At minimum, the medical release form should note any allergies that the child has. However, most forms go further than that and also provide fields for the date of the last Tetanus Booster as well as any past medical problems. Additionally, this section should include the name, address, and phone number of the child's doctor so that the doctor can be contacted regarding any necessary referrals that the insurance company may require.

These generic release forms not only protect the hospital and medical staff from the liability of treating a minor without permission, but it also offers parents or guardians the peace of mind that comes from knowing that if an accident or injury does occur, their children will receive necessary and immediate medical care..
